Hyderabad: The Hyderabad High Court on Friday refused to direct the AP government not to make nominations for constitution of Agricultural Market Committees and continue the existing committees till expiry of their term.

A division bench comprising Justice C. Praveen Kumar and Justice Challa Kodanda Ram was admitting a batch of petitions seeking to declare Amendment Act No. 6 and 10 of the Andhra Pradesh (Agricultural, Produce and Livestock) Markets (Amendment) Act, 2014 as illegal and unconstitutional.

The bench observed that passing any interim order at this stage would amount to the Court appointing them as office bearers, the power of which power is vested with the government.

The bench said the issue of giving retrospective effect from January 1, 2012 to the Amended Act needs to be considered in the final hearing. The bench also made it clear that any appointments made shall be subject to the result of the main writ petitions.
