A CBI court will on Tuesday hear the investigation bureau's application seeking permission to question the accused in the mysterious Sheena Bora murder case. The judicial custody of the three accused - TV tycoon Indrani Mukerjea, ex-husband Sanjeev Khanna and driver Shyam Rai was extended till October 19 on Monday.

However, whether or not Indrani is fit to be questioned will be decided after JJ Hospital submits its report on her health to the prison department. Indrani had collapsed on Friday after in Byculla jail in Mumbai by a suspected drug overdose.

While Indrani is yet to give her statement, reports suggest that a senior Maharashtra Home Department official said it was also being ascertained whether she was "poisoned" inside the jail.

"Prima facie it seems unlikely that she stored the drugs for several days and then ate all of it at one go. Also, we do not see any motive for a prison official to have helped her to attempt suicide."

"If that is the case, we will not hesitate to issue suspension orders for anybody who tried to help her attempt suicide," the official, who is privy to investigation headed by IG (Prisons) into the suspected drug overdose, said.

"When these logical ways of the drug reaching her seem a very distant possibility, what we are focusing now is if somebody tried to poison her. The investigating officer is recording statements of everybody who comes in contact with Indrani in the jail, including prison officials, other inmates and cooks," the official said on condition of anonymity.

There is a prison doctor present at all times, under the supervision of whom inmates are given medicines, the official said. "Thus, we do not think she can store any medicine with her. The doctor, at all times, ensures that inmates consume medicines in their presence."

Indrani was arrested on August 25 for the alleged April 2012 murder of her 24-year-old daughter from an earlier marriage. Sheena was allegedly kidnapped from outside National College in Bandra and strangled to death in a car by Indrani, her former husband Sanjeev Khanna and driver Shyamvar Rai.
