HC Dismisses PIL against Shifting of TS Secretariat
A division bench of the Hyderabad High Court dismissed a public interest litigation petition against the state government’s move to shift the Secretariat to another place in the city.
The petition alleged that the Telangana government had decided to shift the existing State Secretariat to Erragadda under the guise of Vaastu defect’. Expressing displeasure at the petitioner for filing the PIL without required material, the court dismissed it. The bench comprising chief justice KJ Sengupta and justice PV Sanjay Kumar also imposed costs of Rs 1,000 on the petitioner Mohammed Haji, an Aam Aadmi Party leader of the city, for filing the petition on frivolous grounds.
After perusing the records submitted by the advocate-general, the bench noted that there was no mention of “Vaastu” in the decision taken by the government on the issue. It said that the decision was taken after having due deliberations and in consultation with the officers concerned. The bench asked the petitioner to show the basis for filing the said PIL.
Felt annoyed with the petitioner’s counsel’s submission that the case was filed on the basis of newspaper reports, the bench said that the petitioner wanted to create sensationalism by filing such a petition.
It termed the petitioner’s action as abuse of judicial process and imposed costs of Rs 1,000 on him for wasting the court’s time.
