Congress leader Marri Shashidhar Reddy has requested the Centre to recall the Governor of Telangana and Andhra Pradesh E.S.L. Narasimhan alleging that he has deliberately failed to discharge his constitutional duties by not stopping appointment of Telugu Desam MLA Talasani Srinivas Yadav as a Minister in the TRS government.
In a letter addressed to Union Home Minister Rajnath Singh on Saturday, Mr. Shashidhar Reddy requested him to direct the Governor of Telangana to remove Talasani Srinivas Yadav as a Minister in the K. Chandrasekhar Rao Cabinet as his continuation in the government is unethical since he was elected on TDP ticket and not on the ruling TRS symbol.
Mr. Shashidhar Reddy also urged the Centre to relieve the Governor of his responsibilities immediately as the latter had deliberately failed to discharge his duties in preserving, protecting and defending the Constitution and the law of the land.
The former Congress Minister alleged that the Governor had not only violated the provisions of the Constitution but also the judgment of the Supreme Court.
Speaking after releasing the letter to media, the Congress leader explained that Mr. Srinivas Yadav was elected as a legislator from Sanathnagar constituency here on TDP ticket, but the Governor had administered him the oath of office as a Minister in the Cabinet of Mr. Chandrasekhar Rao.
It is from Sanathnagar constituency Mr. Shashidhar Reddy lost the election in 2014.
He stated that TRS was not the political party through which Mr. Srinivas Yadav got elected as a legislator and had become party to the unethical and unprincipled defections encouraged by TRS.
“The Governor deliberately chose to ignore paragraph 2 (1) (a) of the Tenth Schedule of the Constitution and the ratio laid down by the Constitutional Bench of the Supreme Court on February 14, 2003, according to which continuance of a person beyond six months as a Minister is unconstitutional”, Mr. Shashidhar Reddy said.
The Congress leader said he had also written to the Governor in this regard but in vain. He stated that he was planning to meet the President along with a delegation of the Telangana Pradesh Congress Committee (TPCC) and take the matter to his notice.
