Roja suspension case decision reserved for Thursday

Hyderabad: Andhra Pradesh-Telangana joint High Court here on Wednesday reserved its decision in YSR Congress Party MLA R.K. Roja's suspension case for Thursday.

The High Court took up the case on an emergency basis on the direction of the Supreme Court. Earlier the court refused to hear the case stating it did not come under its purview as the suspension was done by the Legislative Assembly Speaker. However, the Supreme Court took a serious note of High Court's rejection when the aggrieved legislator moved it for relief and ordered the state High Court to admit and hear the case immediately.

Petitioner's counsel Indira Jaising argued that the suspension was unconstitutional and violative of the MLA's rights as the decision was taken unilaterally.

As per the clause 370 of the Legislative Assembly rules, suspension of an MLA on the grounds of the language spoken should not exceed the duration of the session. Roja was suspended from AP Assembly for a full year, which is against the rules, the petitioner argued and urged the court to suspend the MLA's suspension immediately so that she could attend the ongoing budget session.

After hearing the arguements of both the parties, the court reserved its decision for Thursday.
