The Andhra Pradesh High court struck down the motion of suspension of YCP leader RK Roja by the State Assembly for 1 year on Thursday. The court gave an interim order, giving a boost to the YCP leader.
The court said that any suspension should be done as per the rules.
When government counsel was asked how could an MLA be suspended for 1 year, he said it was the pleasure of the Assembly.
The government admitted that the suspension was by mistake done under Section 340, when it should have been done under Section 194(3).
Counsel said the Minister who moved the motion, Yanamala Ramakrishnudu, misquoted the rules for the suspension of Roja.
The court postponed the next hearing for 4 weeks.
